Firm Successfully Defends Homeowners' Association

Rule-Making Authority

Houston, Texas, September 27, 2005:  The Rocha Law Firm, PLLC announced today that the firm successfully defended the Potomac Court Condominium Owners' Association from a lawsuit filed by one of its members. The member challenged the validity and enforceability of a rule prohibiting dogs larger than 25 pounds in the common area. 

          "I believe the Court listened to all the evidence and was convinced that the Association's rule was validly passed and enforceable," said Jaime Rocha, principal to the law firm.  At issue before the Court was whether the Association's new rule prohibiting dogs larger than 25 pounds in the common area of the condominiums was unreasonable, arbitrary or capricious.  "That is a very heavy burden for the plaintiff to bear.  The owners' association did its homework and drafted its rule based on other condominium dog rules and tailored the rule to fit its needs," added Rocha.
